Extract From Medical Report of Claimant’s doctor and doctor’s Affidavit
“He was diagnosed as suffering from Depression for the past 1½ years. The history taken from the wife of the Claimant revealed he had been increasingly depressed, agitated, and unable to sleep well. Personality changes easily, hot tempered, very sensitive, having poor appetite, loss of interest in activities, having recurrent negative thoughts. It is unlikely that Claimant will recover from his mental illness. It is my opinion that he is mentally disordered person within the meaning of the term in the Mental Disorders and Treatment Act (Cap 178) and is of unsound mind and is incapable of managing himself and his affairs”
Extract from the Affidavit of the sister of the Claimant
“I am the lawful sister of (Subject) the Respondent. The Respondent is a divorcee who is presently residing with his ex-wife……… and only child of the marriage, namely ………. . My brother was a wage earner of his family. He is however, at present, incapable of looking after himself and is mentally incapacitated from ever continuing in any employment. Having been advised by my solicitors, I am of the knowledge that I can on behalf of my brother, make a claim under the Common Law”
Claimant did not at any time exhibit any deviant behavior and was cheerful and happy when communicating with his wife. He was able to leave his place of abode and travel by bicycle and was safety conscious and abided by the safety rules. He was further able to do the household chores. He was observed reading the classified column of the Chinese Newspaper and identifying the job he was seeking. He travelled by bus and window shopped. Finally he was able to meet his Counsel and engage in a discussion.
Shows Claimant carrying out his household chores, cycling around his estate and even visiting the community centre where he identified jobs from the newspapers and made calls. He was further able to travel by bus, shop around and meet his counsel.
